Standards Working Group - Ken Ficara, Wall
Street Journal, Chair; The Content Standards Working Group
will serve as a resource to SIIA members who are
interested in adopting standards for content format and
management, but who are confused by the plethora of
choices and confusing claims. This group will also attempt
to bring a business focus to standards discussions, in the
hope of influencing standards groups to concentrate on
solving the problems that publishers and editors are faced
with.
Business Models Working Group - Judy Hsieh,
BusinessWeek Online, Chair; The Business Models Working
Group will focus on assessing and providing information on
best practices for business models for electronic content.
The goal will be to conceptualize how buyers and sellers
of data are successfully managing distribution of digital
content today.

DANVERS, Mass., December 15, 2004 – Copyright Clearance
Center, the world’s premier provider of copyright
licensing and compliance solutions, today released a new
report titled Copyright in the Digital Workspace.

As the year 2005 rumbles into view the prospect is for a
time in which the rubble of old business models that began
to come tumbling down in 2004 is pushed aside to make room
for new business models that span old categories and
define highly profitable niches where profits were never

Communications - Another week, another earth-shattering
headline about the machinations of Google. Or is it so
earth-shattering? Google's plan to scan materials without
clear copyright in major libraries is really just a
continuation of their original battle plan. What's more at
question is how publishers and aggregators have been
asleep at the wheel in thinking that copyright law would
promise them growth - as opposed to how it is protecting
dwindling profits based on old business models. Content
value is exploding in electronic form, much of it well
beyond the purview of traditional copyright protection.
The effective use of copyright is far from dead, but its
users must adapt to an era of getting to know its client
base in far more cooperative ways.

the winter meeting of the SIIA Government Affairs Council
will be held at our offices on Wednesday, January 26,
2005. With the start of the 109th Congress, and the onset
of the Administration's second term agenda - as well as a
major changes in leadership in the EU Commission -- the
meeting will be an excellent opportunity to review SIIA's
key agenda items (eCommerce, trade, intellectual property,
privacy, cybersecurity, education and global workforce
issues, among others), as well as a look at the new
challenges facing our industry as we head into 2005.

Issues Final Rule on "Primary Purpose" Test Under CAN-SPAM
Act - Final Rule outlines 4 kinds of emails and the tests it
will apply starting February 18, 2005. The FTC has
publicly released on its website its Final Rule defining
what constitutes a "Commercial Electronic Mail Message,"
although the Rule has not yet been published in the
Federal Register. This Final Rule - commonly referred to
as the "primary purpose rule" - goes into effect on
February 18, 2005.
Member companies will need to review their email
development and implementation practices against the
provisions of the Final Rule, especially where email may
have a "dual purpose" of including commercial content and
either transactional\relationship messages or other
non-commercial content (as in an electronic newsletter).
Special consideration needs to be given to how subject
lines are used in email sent by your organization. Subject
lines play an important role in the FTC's framework.

An Update has been prepared for SIIA members that includes
a summary of the Final Rule, the criteria for determining
