This summer California passed a paradigm shifting privacy law, the CA Consumer Privacy Act (CCPA), effective January 1, 2020, which was the result of a compromise between the bill’s authors and sponsors of a ballot initiative that would have bypassed the legislative process to impose various privacy rights for Californian, and a broad private right of action for violations. The compromise resulted in a much narrower private right of action, but additional privacy rights that the legislative history indicates were inspired by the EU General Data Protection Regulation (GDPR). There are both similarities and material differences between CCPA and GDPR.
