SIIA Tells PTO to Focus on Patent Quality as It Examines AI

Washington, D.C. (November 11, 2019) – The Software & Information Industry Association (SIIA), the principal association for the software, information, and digital content industries, today filed two sets of comments with the Patent and Trademark Office - as a larger group of associations and by itself. Both sets of comments reflect SIIA’s and the larger group’s view that with the growth of artificial intelligence, and the dramatic increase in patent applications on this technology, the Patent and Trademark Office has appropriately asked stakeholders to share their feedback on how best to approach examination in this area.

SIIA VP for Intellectual Property, Chris Mohr, issued the following statement:

"SIIA commends the PTO for initiating this important inquiry. AI is a critical part of our members' present and future. It's very important for policymakers to realize that access to these neural networks is becoming heavily democratized. It's not quite off-the-shelf, but it's getting pretty close,” Mohr said. "In the late 90's and early 2000's, we saw a raft of bad patents issued for performing business methods ‘on a computer’, and a whole lot of litigation abuse as a result.  As AI becomes an increasingly commonplace tool, it's critically important that the PTO apply existing statutory criteria carefully so that ‘using a neural network’ doesn't become the ‘on a computer’ of the next twenty years. PTO has all the tools that it needs through existing law to prevent this from happening.”
