SIIA stresses the importance of the USMCA digital chapter in comments to the Office of the Privacy Commissioner of Canada
WASHINGTON, D.C. (August 2, 2019) – The Software & Information Industry Association (SIIA), the principal association for the software, information, and digital content industries, stressed the importance of the digital chapter of the United States-Mexico-Canada Agreement (USCMA) for preserving the free flow of data in comments submitted to the Office of the Privacy Commissioner of Canada. The comments were in response to the OPC consultation on transfers for processing, which presents a revised interpretation of the 2009 Guidelines for Processing Personal Data Across Borders of the Personal Information Protection and Electronic Documents Act (PIPEDA).
SIIA Senior Vice President for Global Public Policy, Carl Schonander, issued the following statement:
“SIIA recognizes Canada for maintaining a robust, effective, and pragmatic policy framework that encourages cross-border data flows and ensures accountability for the safeguarding of personal data. However, the OPC’s proposed reinterpretation of its transborder data flow policy is incompatible with the USCMA’s chapter on digital trade and will unnecessarily impede data flows between Canada and the United States.
SIIA, therefore, strongly recommends that the OPC abandon this new and unnecessary interpretation of PIPEDA and its proposed revision to the 2009 Guidelines. And further that Canada ensures that any future laws regarding the protection of privacy in the context of transborder data flows and transfers for processing be compatible with Canada’s obligations under USMCA and the APEC CBPR Framework.”
