SIIA Testifying Today Before Senate Judiciary Committee on Patent Eligibility

WASHINGTON, D.C. (June 5, 2019) – The Software & Information Industry Association (SIIA), the principal association for the software, information, and digital content industries, will testify at today’s Senate Judiciary Committee hearing on a discussion draft of legislation amending patent eligibility.  That discussion draft emerged from a series of round tables held during the spring.  

The draft legislation eliminates over a century's worth of carefully developed case law, and replaces it with a broad standard that appears to overrule case law preventing people from patenting business methods – such as hedging risk – because they are done "on a computer."  SIIA will testify on the harmful effects that the draft legislation would have on the software industry.

SIIA Vice President for Intellectual Property and General Counsel, Chris Mohr, issued the following statement:

"For well over a century, the courts have ensured that things like abstract ideas and laws of nature are not subject to patents.  Those rules have been great for the software industry.  Innovation is continuing at a robust pace under existing law.

"The Committee's discussion draft abrogates over a century's worth of case law and replaces it with a standard that the software and information industry does not need and does not want.  The legislation is hopelessly overbroad, as it's trying to solve a problem that, at least for software, doesn't exist.  It would create the very same bars for innovation that the Supreme Court's unanimous AIice decision removed.  

“We appreciate the Committee's consideration of our views and urge it to reconsider the sweeping proposal as we have to oppose this legislation.”
