Panel: The Challenge of Reasonable Commercial Basis (RCB)

The “reasonable commercial basis” (RCB) within European financial market regulation, particularly under MiFIR, aims to ensure fair access to market data. This regulation mandates that fees for market data should be based on the cost of producing and disseminating that data, plus a reasonable margin. The goal is to prevent excessive pricing and promote as wide as possible access to market data. This is fundamental to a well-functioning financial market. Challenges arise in adapting market data agreements and policies to the new framework, new client categorization rules, new rules to set fees, methodologies to determine the true costs of data production, and in enforcing consistent application of the rules. Addressing these challenges requires clear rules and robust supervisory oversight.
