The Software & Information Industry Association (SIIA) joined a number of organizations in expressing support for the use of the Congressional Review Act (CRA) to overturn the Federal Trade Commission’s (FTC) recent premerger notification rules. These rules have been criticized for being unnecessary and overly burdensome, potentially stifling innovation and reducing market efficiencies. The undersigned organizations argue that the new rules assume almost all mergers and acquisitions (M&A) are problematic, imposing excessive bureaucratic demands that could deter beneficial M&A activity. They urge Congress to enact a resolution of disapproval to repeal the FTC’s rule, thereby re-establishing a more predictable and efficient process for agency review of M&A activity.
